Primary function

This staff lawyer position is a hybrid role, with a primary focus on family law services and the ability to perform duties in criminal law. A good understanding of People Soft and certificate management is also required.

Primary Location: London Enhanced Family Duty Counsel Office

Secondary Location: ST Thomas Family and Criminal Duty Counsel Office

Reporting to: Manager of Legal Services

Key accountabilities

  • Act as Family and Criminal Staff Lawyer
  • Representing clients both in-person and remotely
  • Ensure high quality of legal work in a cost effective manner
  • File management as per LAO requirements including use of computer technology; data input for statistics measurements in a timely manner
  • Travel to and from Primary and Secondary work locations
  • Other duties and assignments that may arise from time to time

Family

  • Advocate for clients in court and on court forms
  • Provide family law duty counsel services, including providing instructions to Legal Aid Workers (and students), preparation of court documents for eligible clients, make appropriate referrals when required, including to mediation services
  • Providing representation in the Ontario Court of Justice (OCJ), Superior Court of Justice (or Unified Family Court) at first appearances, conferences, motions, negotiations, Family Responsibility Office (FRO) matters, Children’s Aid Societies matters and other court hearings and services as required
  • Assist unrepresented eligible clients with LAO family settlement conferences as required
  • Assist unrepresented clients with Child Youth and Family Services Act (CYFSA) matters (with document preparation and in court appearances)
  • Ability to provide advice lawyer services at the Family Law Information Centre (FLIC)
  • Demonstrated ability to provide sensitive and compassionate client service to those who may be victims of domestic violence
  • Provide advice Lawyer Services in the Family Law Information Centre (FLIC)
  • Maintain client files and conflict lists
  • Other duties as assigned

Criminal

  • Assisting unrepresented clients who have been charged with criminal matters
  • Representing clients at bail hearings, guilty pleas and remands both in-person and remotely
  • Assessing clients’ needs, including the early identification of vulnerable clients, to facilitate referrals to appropriate services.
  • Provide criminal law services as defense counsel in the Ontario Court of Justice
  • Providing assistance and representation at federal, provincial, and youth, remand, bail and plea courts, including specialty courts (Drug Treatment Court / Mental Health Court / Gladue Court)
  • Interviewing clients, sureties, and witnesses
  • Disclosure review and Crown pre-trials meetings
  • Assisting with various motions and hearings (may include trials), including judicial pre-trials
  • Preparing and arguing bail hearings
  • Other duties as assigned

Required Skills & Experience

  • Member in good standing with the Law Society of Ontario

Family

Intermediate:

  • Demonstrated Knowledge and experience of relevant family law legislation and in particular child protection law and in court experience in both family and child protection matters. Experience being lead on family files.

Intermediate

  • Ability to draft legal documents without need for review

Criminal

Intermediate Level Statement

  • Demonstrated experience in representing clients with complex legal issues including conducting bails hearings, and guilty pleas.

Intermediate Level Statement

  • Proven experience in providing excellent client service to vulnerable populations such as racialized communities, First Nations, youth and those experiencing mental health or addiction challenges or victims of domestic violence and/or homelessness

Intermediate

  • Demonstrated knowledge of Word, Excel, Outlook and PowerPoint, Divorcemate, Teams or Zoom platforms
  • Ability and willingness to travel between the district court locations.

Sommaire du poste

Ce poste d’avocat(e) salarié(e) sera hybride et principalement axé sur les services en droit de la famille. La personne retenue sera également appelée à effectuer des tâches en droit criminel. Une bonne compréhension de PeopleSoft et de la gestion des certificats est requise.

Fonctions

  • Fournir des services en droit de la famille et en droit criminel.
  • Représenter les clients en personne et à distance.
  • Assurer un travail juridique de qualité qui soit efficace par rapport aux coûts
  • Gérer les dossiers conformément aux exigences d’AJO, y compris l’utilisation de la technologie informatique; saisir les données pour les analyses statistiques de façon régulière.
  • Se déplacer entre les lieux de travail principaux et secondaires.
  • Effectuer d’autres tâches et missions ponctuelles.

Droit De La Famille

  • Défendre les droits des clients au tribunal et sur les formulaires judiciaires.
  • Fournir des services d’avocat de service en droit de la famille, en personne et à distance, en donnant des instructions aux auxiliaires de l’aide juridique (et aux étudiantes et étudiants), en préparant les documents judiciaires pour les clients qui sont admissibles à ce service, et au besoin en faisant les renvois, notamment vers les services de médiation.
  • Assurer la représentation devant la Cour de justice de l’Ontario(CJO), la Cour supérieure de justice (tribunaux unifiés de la famille) pour les premières comparutions, les conférences, les motions, les négociations, les affaires relevant du Bureau des obligations familiales (BOF) ou des Sociétés d’aide à l’enfance, ainsi que pour d’autres audiences et services judiciaires, selon les besoins.
  • Aider les clients admissibles non représentés dans le cadre de conférences de règlement à l’amiable d’AJO.
  • Fournir des services aux clients non représentés dans des affaires relevant de la Loi sur les services à l’enfance, à la jeunesse et à la famille (LSEJF) (préparation de documents et comparutions en cour).
  • Fournir des services d’avocat-conseil au Centre d’information sur le droit de la famille (CIDF).
  • Capacité démontrée à fournir un service sensible et compatissant aux personnes susceptibles d’être touchées par la violence familiale.
  • Fournir des services d’avocat-conseil au Centre d’information sur le droit de la famille (CIDF).
  • Tenir à jour les dossiers des clients et les listes de litiges.
  • Assumer d’autres responsabilités selon les besoins.

Droit Criminel

  • Aider les clients non représentés faisant l’objet d’accusations criminelles.
  • Représenter les clients lors des enquêtes sur le cautionnement, des plaidoyers de culpabilité et des ordonnances de détention, en personne ou à distance
  • Évaluer les besoins des clients et déterminer rapidement la vulnérabilité des clients afin de les orienter vers les services appropriés.
  • Fournir des services en droit criminel à titre d’avocate ou avocat de la défense à la Cour de justice de l’Ontario.
  • Fournir de l’aide et des services de représentation dans les tribunaux provinciaux et fédéraux, les tribunaux pour adolescents, des ordonnances de détention, des mises en liberté sous caution et des plaidoyers de culpabilité, y compris les tribunaux spécialisés (tribunaux de traitement de la dépendance, de la santé mentale et Gladue).
  • Effectuer des entrevues avec les clients, les cautions et les témoins.
  • Participer aux réunions d’examen du dossier de divulgation et aux réunions préparatoires au procès avec la Couronne.
  • Participer à différentes requêtes et audiences (peut comprendre les procès), notamment les conférences judiciaires préparatoires au procès.
  • Préparer les observations sur le cautionnement et en débattre aux enquêtes sur le cautionnement.
  • Assumer d’autres responsabilités selon les besoins.

Exigences

  • Être membre en règle du Barreau de l’Ontario.

Droit De La Famille

Niveau intermédiaire :

  • Connaissance démontrée et expérience des lois pertinentes en droit de la famille, y compris en droit relatif à la protection de l’enfance, la représentation en cour dans des affaires de droit de la famille ou de protection de l’enfance. Expérience comme avocate ou avocat principal dans la gestion des affaires familiales.

Niveau Intermédiaire

  • Capacité à rédiger des documents juridiques sans révision.

Droit Criminel

Niveau intermédiaire :

  • Expérience démontrée de représentation de clients ayant des problèmes juridiques, notamment dans le cadre d’enquêtes sur le cautionnement et de plaidoyers de culpabilité.

Niveau Intermédiaire

  • Expérience démontrée de prestation d’excellents services aux clients vulnérables, notamment les membres des communautés racialisées et des Premières Nations, les jeunes et les personnes qui ont des troubles mentaux ou de dépendance, les personnes touchées par la violence familiale ou qui sont itinérantes.

Niveau Intermédiaire

  • Connaissance démontrée de l’utilisation des logiciels Word, Excel, Outlook et PowerPoint, Divorcemate, des plateformes Teams et Zoom.
  • Capacité et volonté de se déplacer entre les sites des tribunaux du district.
