The College is the authority mandated by the Government of Canada to regulate the practice of Regulated Canadian Immigration Consultants (RCICs) and Regulated International Student Immigration Advisors (RISIAs). Its role, authority and powers are established in the College of Immigration and Citizenship Consultants Act (Canada). The College sets and enforces the licensing, education and ethical standards of the profession in the public interest.

How will this role support our team? 

 

The incumbent investigates complaints of professional misconduct in an unbiased and professional manner while ensuring transparency, efficiency, and public protection. 

 

Responsibilities Include (but are not limited to)

 


  • Review complaints to assess risk and identify potential conduct issues relating to the College’s Code of Conduct, By-laws, and legislation

  • Investigate complaints and allegations of professional misconduct

  • Collect, interpret, document, and preserve relevant information and evidence. This can include obtaining and executing production orders, subpoenas, and warrants

  • Conduct interviews with complainants, witnesses, and licenses to assist counsel, the Complaint Committee and Discipline Committee in determining the facts of the case

  • Liaise with other stakeholders including the public, counsel, Tribunal members and enforcement agencies to gather additional information

  • Prepare the Final Investigation Report (using the applicable template) for submission to the appropriate team members or committee

  • Provide support for the hearings process by preparing and reviewing documentation for hearings and testifying at disciplinary hearings, as necessary

  • Collaborate with other staff to identify trends and patterns requiring further investigation (e.g., fraudulent schemes and repeat offenders)

  • Critical thinking and analytical skills to analyze and draw conclusions about evidence

  • Time management and organizational skills to manage and prioritize competing priorities and deadlines

  • Organizational skills to keep track of deadlines and a high volume of case documents and materials

  • Flexibility to work in a fast-paced changing environment as a collaborative team player who demonstrates initiative 

  • Interpersonal and stakeholder relationship management skills to de-escalate and interact professionally and respectfully with stakeholders (licensees, witnesses etc.) who are often stressed, upset or angry about their case 

  • Written and verbal communication skills to prepare case materials (e.g., complaint report, interview summaries, affidavits), testify at disciplinary hearings and to communicate with parties diplomatically and respectfully, many of whom have language barriers

  • Attention to detail to ensure accuracy and completeness of review and documents/materials

  • Tact and discretion to work on confidential and sensitive matters  

Required Education and Experience


  • College Diploma in a related field such as business, risk, immigration, investigations, or law enforcement, plus additional training or certification in a related discipline (e.g., fraud, investigation)

  • 3-5 years of experience working in an investigative capacity in a regulatory or enforcement agency

  • Knowledge of investigative processes, evidentiary rules and assessment, interview techniques, cyber investigations, and methodologies

  • Knowledge of legal and administrative law principles such as procedural fairness, confidentiality, privacy, human rights, and evidence law. Ability to acquire knowledge of the College Act, regulations, By-laws, and Code of Professional Conduct

  • Knowledge of office/administrative software

Le titulaire du poste fait enquête sur les plaintes pour manquement professionnel d’une manière impartiale et professionnelle tout en assurant la transparence et l’efficience du processus, ainsi que la protection du public.  

 

Les responsabilités comprennent les éléments suivants (sans toutefois s’y limiter)


  • Examiner les plaintes afin d’évaluer les risques et cerner les problèmes potentiels liés à la conduite en vertu du Code de déontologie du Collège, du Règlement administratif et de la loi

  • Enquêter sur les plaintes et allégations relatives au manquement professionnel

  • Recueillir, interpréter, documenter et conserver les renseignements et les éléments de preuve pertinents. Il peut s’agir d’obtenir des citations à comparaître et des mandats

  • Mener des entrevues avec les plaignants, les témoins et les titulaires de permis afin d’aider le conseiller juridique, le Comité des plaintes et le Comité de discipline à établir les faits de l’affaire en cause

  • Assurer la liaison avec d’autres parties prenantes, incluant les membres du public, les conseillers juridiques, les membres du Tribunal et les organismes d’application de la loi afin de recueillir des renseignements supplémentaires

  • Assurer la liaison avec les titulaires de permis et leurs conseillers juridiques dans le but d’obtenir les dossiers clients, les communications et les documents pertinents dans le cadre d'une enquête

  • Préparer les documents d’enquête et le rapport d’enquête final qui seront soumis aux membres de l’équipe ou du comité appropriés

  • Fournir du soutien dans le cadre du processus d’audience en préparant et révisant les documents en prévision des audiences et en témoignant dans le cadre d’audiences disciplinaires, si nécessaire

  • Collaborer avec d’autres membres du personnel afin de cerner les tendances et les pratiques exigeant une enquête plus approfondie

  • Sens de l’organisation permettant de gérer les échéances et un volume élevé de documents et de dossiers liés aux cas

  • Souplesse permettant de travailler dans un environnement au rythme rapide et changeant en faisant preuve d’un esprit d’équipe et d’initiative

  • Aptitudes pour la gestion des relations interpersonnelles et des relations avec les parties prenantes permettant de désamorcer une situation et d’interagir de manière professionnelle et respectueuse avec les parties prenantes (titulaires de permis, témoins, etc.) qui éprouvent souvent du stress, de l’inquiétude ou de la colère face à l’affaire en cause

  • Aptitudes pour la communication écrite et verbale permettant de préparer les dossiers relatifs aux cas (p. ex. rapports de plainte, résumés des entrevues et affidavits), de témoigner dans le cadre d’audiences disciplinaires et de communiquer avec diplomatie et respect avec des parties qui font souvent face à des barrières linguistiques

  • Souci du détail permettant de veiller à l’exactitude et à l’exhaustivité de l’examen des documents et des dossiers

  • Tact et discrétion afin de traiter des questions de nature confidentielle et sensible

Formation et expérience requises


  • Diplôme collégial dans un domaine connexe comme les affaires, le risque, l’immigration, les enquêtes ou l’application de la loi, en plus d’autres formations ou certificats dans une discipline connexe (p. ex. fraude, enquête)

  • Trois à cinq années d’expérience dans un poste lié aux enquêtes au sein d’un organisme de réglementation ou d’application de la loi

  • Connaissance des processus d’enquête, des règles de preuve et de l’évaluation de la preuve, ainsi que des techniques d’entrevue, des cyberenquêtes et des méthodes qui s’y rattachent

  • Connaissance des principes juridiques et du droit administratif, tels que l’équité procédurale, la confidentialité, la protection de la vie privée, les droits de la personne et le droit de la preuve Capacité à acquérir des connaissances sur la Loi sur le Collège, les règlements, le Règlement administratif et le Code de déontologie

  • Connaissance de logiciels bureautiques et administratifs
